(Oral) This is a second petition for grant of anticipatory bail to the petitioner in FIR No.047 dated 19.06.2019 under Sections 323, 324, 326, 341, 427, 148 and 149 of the Indian Penal Code (Sections 336 and 337 IPC and Sections 25 and 27 of the Arms Act have been deleted) registered at Police Station Bhaini Mian Khan, District Gurdaspur. The earlier one i.e. CRM-M-40348-2019 was dismissed as withdrawn on 24.09.2019. During the course of argument, the learned counsel for the petitioner could not raise any new ground to file this anticipatory bail after a period of 11⁄2 years of registration of the FIR and therefore, the learned counsel restrict his argument to the extent that the petitioner be permitted to surrender before the learned trial Court and a direction be issued to the learned trial Court to decide his regular bail application expeditiously.

CRM-M-9229-2021 -2Accordingly, in view of the limited prayer of the petitioner, the present petition is disposed of with a direction to him to surrender before the learned Illaqa Magistrate within a period of 07 days from today and after doing the same, in case, the petitioner moves a regular bail application before the learned trial Court, the same shall be decided within a period of 05 days thereafter.
