HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.41 dated 17.02.2019 under Section 20 of NDPS Act (Section 61/85 of NDPS Act added later on) registered at P.S Urban Estate, Hisar, District Hisar. As per allegations in the FIR, 25 kg 700 grams of ganja was recovered from the petitioner.
Learned counsel for the petitioner submits that the investigation is complete. The trial is not making any headway and that the petitioner is in custody since 17.02.2019 and that he has no criminal past. Without commenting anything on the merits of the case and also bearing in mind the custody period coupled with the fact that the trial is not likely to be concluded in near future, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Tahir is ordered to be released on bail on her furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. This present petition stands accepted accordingly.
