(ORAL) This is a petition that has been filed for grant of regular bail to the petitioner in case FIR No.167 dated 12.11.2019 registered under Sections 376 and 120-B IPC (Sections 3 & 4 of POCSO Act, 2012 added later on) at Police Station Nehianwala, District Bathinda. Counsel for the petitioner herein submits that the petitioner has already undergone a period of 10 months 16 days and the trial is not proceedings. Apart from arguing the custody, learned counsel for the petitioner also contends that the petitioner had suffered a stroke and would require treatment.

Counsel for the respondent-State has filed reply in which medical status of petitioner-Veerpal Kaur in which the medical status of Veerpal Kaur has been furnished. The report itself would show that the petitioner was admitted at Guru Gobind Singh Medical College and Hospital, Faridkot on 16.06.2020 and discharged on 20.06.2020 and now is to be treated for residual paralysis and weakness and has been referred to Civil Hospital, PANKAJ KUMAR 2020.09.30 16:28 I attest to the accuracy and integrity of this document

I have heard learned counsel for the parties. Keeping in view the fact that there is outbreak of COVID-19 pandemic, the instant petition is allowed and the petitioner is directed to be released on interim bail forthwith for a period of two months on execution of adequate personal/surety bond of an amount of Rs.50,000/- to the satisfaction of concerned trial Court/Duty Magistrate. She shall surrender before the concerned trial Court/Duty Magistrate on 01.12.2020. However, any observation made herein shall not be construed to be an expression on merits of the case.
