The applicant has come up against the judgment of acquittal dated 09.09.2016 passed by the trial Court, under Section 378(4) Cr.P.C. 2.
The case was called out twice.

On the last date of hearing i.e. 16.09.2024, this Court had passed the following order which reads as under:

None has appeared on behalf of the applicant. List on 23.09.2024.
It is clarified that in case the applicant remains absent on the next date of hearing, then this Court might dismiss the case for non-prosecution." 4.
The applicant-appellant is unrepresented today. 5.
