T.P.S. MANN, J. (Oral) Gurpreet Singh, who had received injuries in the occurrence filed the present application under Section 378(4) Cr.P.C. for grant of leave to appeal against the impugned judgment to the extent of acquitting accused/respondents No. 2 to 5 of the charge under Section 308 IPC.
Admittedly, during the occurrence, the applicant had received four injuries. Three of them were lacerated wounds, which were on his legs whereas injury No.4 was pain and tenderness over lower back. None of them was on vital parts of the injured. Further, injuries No.1 and 2, which were on the left leg of the injured were declared grievous in nature. Under these circumstances, the accused have rightly been exonerated of
CRM-A-2152-MA of 2016 -2the charge under Section 308 IPC and convicted under Section 325 IPC.
There being no merit in the application, the same is dismissed. Leave to appeal is declined.
