The present application bearing CRM-39039-2022 has been filed by Subhash Chander son of respondent No.2-Kurda Ram with prayer that the main appeal filed by appellant i.e. SDO (Operation) Sub-Division DHBVNL, Satrod Tehsil and District Hisar has been abated on account of death of his father Kurda Ram. The present application is supported by the death certificate of respondent No.2-Kurda Ram, which is Annexure A-1. Keeping in view the fact and circumstance of the present case, main case is preponed and the same is taken on board today itself. ( 2 ) CRM-39039-2022 in/and CRM-A-2175-MA-2016 In view of the above as respondent No.2-Kurda Ram, who was acquitted by the trial Court vide judgement dated 17.12.2015 and against the said judgment, appeal has been filed by the aforesaid appellant and as respondent No.2 has died, the main appeal stands abated. Consequently, CRM-A-2175-MA-2016 is hereby disposed of being stands abated and CRM-39039-2022 is also disposed of accordingly.
