Asha Kumari v. State Of Haryana And Others
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP-3986-2022 Date of decision: March 14, 2022 Asha Kumari .....Petitioner versus State of Haryana and others ......Respondents CORAM: HON'BLE MR. JUSTICE ARUN MONGA
Present:
Mr. Atul Yadav, Advocate for the petitioner.
Ms. Kirti Singh, DAG Haryana.
***** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of Mandamus directing the respondents to grant additional 5 marks to the petitioner as per clause 2.3 of the Advertisement No.15/2019 (Annexure P10). 2.
Learned counsel for the petitioner submits that petitioner has wrongly not been given 05 marks meant for those candidates who do not have any of their family members in Government service. She has thus, been meted out with hostile discrimination while other similarly situated candidates have been accorded the benefit thereof. 3.
Pursuant to an earlier order dated 02.03.2022 passed by this court, learned State counsel informs that petitioner has secured an aggregate of 49.5 marks (43 marks in the written examination + 6.5 marks towards socio-economic criteria). The cut off marks for the MPHW (F) candidate under the SC category is 58 marks and the last selected candidate in the waiting list has secured 57 marks. And even if additional 05 marks, as MAHAVIR SINGH 2022.03.15 11:18 I attest to the accuracy and authenticity of this document
claimed, are awarded, she would still not make the cut as the cut off in the category petitioner applied is 58 marks.
4.
In the premise, it seems that being unaware of her actual result, the petitioner was misled into filing the instant petition premised on an understanding that she has obtained 50 marks in the written examination. However, she has actually scored 49.5 aggregate marks, as aforesaid. 5.
The result of the petitioner is not under challenge before this Court. Being so, no further grounds to interfere are made out. 6.
Dismissed.
