(ORAL) The main appeal, filed by the wife - appellant, assails the order dated 25.11.2019 passed by the learned Principal District Judge, Family Court, Hisar, whereby the petition under Section 13 of Hindu Marriage Act, 1955, filed by the respondent-husband (Ravi Kumar) on the grounds of cruelty, desertion and adultery, was ex parte allowed, and the decree of divorce for dissolution of marriage was granted. The main appeal stands adjourned for 30.06.2021, wherein notice has not been issued as yet.
Today, an application bearing CM No. 4589-CII of 2021 (duly supported by the affidavit dated 27.04.2021 of the appellant - Geetanjali) has been filed by the applicant-appellant, seeking withdrawal of the aforesaid appeal. It is averred in the application that the matter has been compromised between the parties, hence, the applicant-appellant does DINESH KUMAR 2021.05.06 14:28 I attest to the accuracy and integrity of this document not want to further pursue the present appeal, and prays for permission to
CM No. 4589-CII of 2021 in/and FAO No. 1330 of 2020 (O&M) -2withdraw the present appeal.
On the oral request of counsel for the applicant-appellant, the date of hearing of the main appeal is preponed from 30.06.2021 and taken up today itself.
In view of above and contents of the application bearing CM No. 4589-CII of 2021, the same is allowed and the main appeal is hereby dismissed as withdrawn.
