(Oral) Prayer is for grant of anticipatory bail to the petitioner in case having DDR No.21 dated 13.3.2018 for offence under Sections 307, 452, 148, 149 IPC and Sections 25/27 of Arms Act registered at Police Station Sadar Patti, District Tarn Tarn in FIR No.46 dated 9.3.2018 registered under Sections 307, 452, 506, 148, 149 IPC and Sections 25/27 of Arms Act at Police Station Sadar Patti, District Tarn Taran. The counsel for the petitioner has contended that the aforesaid DDR was registered on the basis of statement of Dalbir Singh regarding cross-version to the main occurrence having FIR No.46 dated 9.3.2018. The counsel for the petitioner further submitted that the petitioner has joined the investigation with the police in compliance of order dated 7.12.2021 passed GAURAV SOROT 2022.02.22 16:34 I attest to the accuracy and integrity of this document

( 2 ) CRM-M-7014-2020 by the Co-ordinate Bench of this Court. It is further contended that one Manbir Singh who was named as accused in the main case having FIR No.46 and who is stated to have caused fire arm injury, was granted anticipatory bail by the Co-ordinate Bench of this Court vide order dated 18.9.2018 (Annexure P-5).

The State counsel on instructions from ASI Jagjit Singh submitted that the petitioner who has joined the investigation is not required by the police for any custodial interrogation. The State counsel also admitted the fact that it is a case of version and cross-version. As per the allegations appearing on the record at the time of alleged occurrence, the petitioner caused fire arm injury on the left leg of Darshan Singh, in cross-version case. Admittedly Manbir Singh, who is named as accused in main case having FIR No.46 and is stated to have caused fire arm injury on the right wrist of Gurpreet Singh was granted anticipatory bail by this Court vide order Annexure P-5. The petitioner has joined the investigation with the police and as has been stated by the State counsel is not required by the police for any further investigation.

In view of the above without commenting on the merits of the case, the present petition is allowed and the order of interim bail dated 7.12.2021 is hereby made absolute.
