(Oral) Prayer in this petition is for transfer of investigation in case FIR No.0017 dated 09.02.2023, under Section 323 IPC and Sections 8, 10, 17 of Protection of Children from Sexual Offences Act (Amended), 2012, registered at Police Station Kartarpur, District Jalandhar Rural (Annexure P-1) to some independent investigating agency under a statute/an officer of the rank of SSP in the Vigilance Department in Punjab or in the alternative to direct formation of a Special Investigation Team headed by officer of the rank of SSP or above.

Status report by way of affidavit of Sukhwinderpal Singh, PPS, Deputy Superintendent of Police, Sub Division Kartarpur, District Jalandhar (Rural), dated 12.7.2023, on behalf of respondents No.1 to 3 has already been filed. 2023:PHHC:106664 CRM-M-8667-2023 the DSP Sub Division Kartarpur had recommended the cancellation report to be filed in the matter, however, the Senior Superintendent of Police, Jalandhar (Rural) disagreed with the report submitted by the said Deputy Superintendent of Police, Sub Division Kartarpur. After taking comments from the Superintendent of Police (Detective) Jalandhar, the concerned SHO was directed to arrest the abovesaid accused and to further file challan in the abovesaid FIR in the learned trial Court after completing the investigation. In view of the aforesaid position, learned counsel for the petitioner expresses satisfaction with the investigation and submits that the present petition may be disposed of as fully satisfied. Ordered accordingly.
