**** HARNARESH SINGH GILL, J.(Oral) Prayer in this petition is for issuance of a writ in the nature of Certiorari quashing the impugned action of the respondents for not granting the benefit of 3rd Assured Career Progression (ACP) grade pay of Rs.3600 to the petitioner w.e.f. 01.05.2021, being in violation of Rules

(3) and (4) of the Haryana Civil Services (Assured Career Progression) Rules, 2016 and Notification dated 04.03.2014 (Annexure P-2). Learned counsel for the petitioner submits that, though, vide letter dated 25.06.2022 issued by Principal, Government Senior Secondary, Kosli, the claim of the petitioner with regard to grant of 3rd ACP, was declined, yet no reason has been mentioned and that it has only been mentioned in the said letter that the DSE has raised objection that the employee (the petitioner) is not eligible for 3rd ACP. He further submits that the petitioner issued a legal notice dated 15.06.2022, but to no avail.

On the asking of this Court, Ms. Tanushree Gupta, DAG Haryana, accepts notice on behalf of the respondents. I have heard the learned counsel for the parties. The petitioner is directed to move a fresh representation raising all his grievances with regard to grant of 3rd ACP to respondent No.2-Director Secondary Education, Haryana, within 15 days from the receipt of the certified copy of this order, if so advised. On his doing so, respondent No.2 is directed to decide the same, within 8 weeks thereafter, by passing a detailed speaking order, as per law. Disposed of in the above terms.
