On 9.2.2026, the following order was passed:

'Petitioner, an accused in case FIR No. 0006 dated 7.1.2026, registered against him under Sections 115(2), 118(1), 118(2), 351(2), 191(3), 190 of BNS, at Police Station Kartarpur, Jalandhar, has filed the present petition for grant of anticipatory bail.

Learned counsel for the petitioner contends that petitioner has been falsely implicated in the present case, on account of personal rivalry with the complainant party. Even if the allegations as levelled in the FIR, are taken to be true at its face value, the only role attributed to the present petitioner is that he caught hold of complainant when his other accomplices hit the complainant. It is further the submission of learned counsel that taking note of the aforesaid fact, learned Additional Sessions Judge, Jalandhar, vide order dated 28.1.2026 granted the concession of interim bail to the petitioner. But on account of false complaint given by the complainant, the said concession was not extended and finally the application for grant of pre-arrest bail was dismissed by learned Additional Sessions Judge, Jalandhar vide order dated 30.1.2026. Learned counsel contends that

CRM-M No.7294 of 2026 -2petitioner did not indulge in any sort of activity as alleged by the complainant. He did not influence/overawe either complainant or related witnesses. Complaint filed by the complainant is just another clever tactics adopted by him to overawe petitioner. Learned counsel further contends that petitioner, whose past antecedents are quite clean and he is not involved in any other case, is ready and willing to join the investigation as and when called for by the Investigating Officer. Notice of motion.

Mr. Kamalpreet Bawa, Deputy Advocate General, Punjab, accepts notice on behalf of respondent-State and prays for time to file status report. In view of submissions advanced by learned counsel for petitioner, petitioner is hereby directed to join investigation within seven days from today and co-operate in the same. In the event of the arrest of petitioner, he shall be released on interim bail on his furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. He shall also abide by conditions as envisaged under Section 482(2) BNSS. List on 29.4.2026.'

Learned State counsel has filed status report by way of affidavit of Narinder Singh, PPS, Deputy Superintendent of Police, Sub-Division Kartarpur, Jalandhar (Rural) in Court today. The same be kept on record. Raising submissions in tandem with the said status report, learned State counsel submits that pursuant to the order dated 9.2.2026, the petitioner has joined investigation and is no longer required for custodial interrogation.

In view of the above, the instant petition is allowed. Interim order dated 9.2.2026, passed by this Court is made absolute, subject to the conditions as enumerated under Section 482(2) of BNSS. 4.

This order should not be treated as "blanket" order. It will not be read granting petitioner indefinite protection from arrest. It shall be

CRM-M No.7294 of 2026 -3confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence. 5.

Liberty is reserved in favour of State/complainant to move for cancellation/recall of this order in case the petitioner violates any condition stipulated under Section 482(2) of BNSS or upon showing any other sufficient cause.
