(Oral) The present case initially was got registered by father of a girl aged around 14/15 years. In his statement the complainant alleged that on 4.6.2018 the victim his daughter went to Ghasola in the evening but thereafter disappeared and his Rs 2000/- too were missing from the house. From the investigations, it transpired that the petitioner had taken away the victim and kept her with him and defiled her. The present case was got registered in which the

-2petitioner was got arrested on 22.6.2018.

Learned counsel for the petitioner has forcefully argued that the girl was aged between 15 to 16 years and had eloped on her own with the petitioner and that there is nothing suggestive from her medico legal examination that she was raped against her wishes arguing that the trial is not likely to be concluded in the near future. Learned State counsel submits that the girl in her stand before the police and in statement under Section 164 Cr.P.C. before the court had fully supported the version of the prosecution and the petitioner who is a married person with kids had enticed and taken away a minor girl and kept in illegal confinement and violated her repeatedly does not calls for grant of any relief. Heard.

As is there on the records, the girl is aged between 14 to 15 years and so is the fact that the petitioner is a married person with kids and the statement under Section 164 Cr.P.C. before the court are illustrative of this crime. The medical evidence supports the fact that the child has been violated and thus in view of heinousness of crime and seriousness of allegations does not calls for grant of bail and the present petition stands dismissed.

The observations made herein above shall have no bearing on the merits of the case as these are purely for the disposal
