Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondent authorities to act in line as per settled law by the Hon'ble Apex Court and to step up the pay and pension (w.e.f. 04.09.1981 i.e. the date of catching up) of the petitioner who is a general category employee and had finally managed to catch up at par with his junior colleague who had happened to gain promotions prior in time by virtue of being an employee from the reserved category.

CWP No.3301 of 2024 (O&M) (Annexure P-3). He submits that at this stage, petitioner would be satisfied, if the said representation is decided by passing a speaking order within a time bound frame.

Mr. K.S. Kharbanda, Advocate, accepts notice on behalf of the respondents and submits that there is a considerable delay in filing the present petition, however, the said contention has been refuted by learned counsel for the petitioner by submitting that the case of the petitioner is under consideration as is clear from letter dated 18.09.2023 (Annexure P-4).

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.1 to decide representation dated 23.08.2023 (Annexure P-3), submitted by the petitioner expeditiously, by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
