The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondents to grant 2/3 advance increments on the basis of their higher qualification. 2.

The petitioners No. 1 to 7 are former employees of Government Aided Private Schools in Chandigarh. They are claiming that on the basis of higher qualification, they should be given more increments. Counsel for the respondents submit that benefit claimed by petitioners has not been extended to Government School Teachers working in the Union Territory of Chandigarh, thus, their claim is not sustainable. 4.

From the office report as well as in view of statement of counsel for the petitioners, all the petitioners have already retired and few of them have passed away. There is nothing on record disclosing that there was fundamental or vested right of petitioners to claim advance increments. The respondents have candidly argued that teachers of Government schools in Union Territory of Chandigarh are not granted benefit/increments claimed by the petitioners.

In the above premise, the instant petition deserves to be dismissed and accordingly dismissed.
