The petitioner apprehending arrest in the FIR captioned had come up before this Court under Section 438 CrPC seeking anticipatory bail. 2.
State counsel opposes the present petition on the ground of non-disclosure of FIR under 324 IPC and under Excise Act.

Counsel for the petitioner submits that he be permitted to withdraw the present petition with liberty to file fresh petition after disclosing all the criminal antecedents. 4.
Given above, the present petition is disposed of as withdrawn with the liberty aforesaid. It is clarified that withdrawal of this petition shall not come in the way of the petitioner in any manner whatsoever. All pending applications, if any, also stand disposed.
