(Oral) The appellant has filed the instant appeal against the judgment and decree dated 12.09.2016 passed by the learned trial Court whereby the suit for declaration filed by the plaintiff/appellant has been dismissed as well as the judgment and decree dated 04.11.2019 passed by the learned Appellate Court whereby the appeal preferred by the appellant against the aforesaid judgment and decree dated 12.09.2016, has also been dismissed.

Learned counsel for the appellant had sought adjournment on 07.02.2024 for bringing on record the legal representatives of the appellant. Thereafter, again adjournment was sought on 22.07.2024 for the said purpose, however, no legal representatives of the appellant have been brought on record.

RSA-294-2022 (O&M) Learned counsel for the appellant submits that despite his best efforts, he has not been able to get instructions from the legal representatives of the appellant, therefore, they could not be brought on record.

In this view of the matter, the present appeal is dismissed for non-prosecution with liberty to revive the same, on filing an appropriate application, in case the legal representatives of the appellant are interested to pursue the present appeal.
