The present petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioner in case FIR No.48 dated 20.02.2021 under Sections 294, 323, 506 and 34 IPC 1860 registered at Police Station Urban Estate, Hisar District Hisar. Learned counsel for the petitioner states that pursuant to order dated 27.08.2021, passed by this Court, the petitioner has joined the investigation and cooperated with the investigating agency. Learned State counsel assisted by counsel for the complainant on instructions from LHC Sweety does not dispute the factum of the petitioner having joined the investigation. She, on further instructions states that the petitioner is not required for further investigation. Learned counsel for the complainant, however, submits that subsequent to the grant of interim bail vide order dated 27.08.2021, petitioner had inflicted injuries on the person of the complainant as a result of which a FIR was registered against him under Sections 323, 324 and 34 SONIA BURA 2022.02.01 10:43 I attest to the accuracy and integrity of this document chandigarh

On a query put to the State counsel as to the authenticity of the submissions made by counsel for the complainant, she submits that the investigating agency during investigation had found that the injuries so sustained by the complainant were under suspicious circumstances and the statement of the daughter of the complainant had also been recorded to the effect that those injuries had been inflicted by the complainant herself. Be that as it may, once the petitioner has joined the investigation and is not required for further investigation, this Court would not hesitate to extend the concession of anticipatory bail to the petitioner. In the circumstances, the petition is allowed and interim order dated 27.08.2021, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
