(Oral) The prayer in the present petition under Section 439 is for the grant of regular bail to the petitioner in case FIR No. 192 dated 11.05.2018 under Section 307 IPC (Section 302 IPC added later on) and Section 25/27 of the Arms Act, registered at Police Station Basti Jodhewal, District Ludhiana.

None appears on behalf of the petitioner even on second call. The learned counsel for the State has filed a status report by way of affidavit of Maninder Bedi, PPS, Assistant Commissioner of Police (North), Ludhiana, dated 21.09.2022. As per the said status report, the petitioner is the person who shot at the deceased-Amit Kumar on his chest and thereafter, picked up the empty shell of the gun-shot and put the same in some plastic bag and hid the same by digging a hole in a vacant plot. The CCTV footage of the place of the occurrence on the date of incident also shows that the petitioner was sitting on the back of the motorcycle alongwith SUKHPREET KAUR 2022.09.23 14:00 I attest to the accuracy and integrity of this document one Gagandeep Singh @ Mor. petitioner has led to the recovery of an empty shell of .315 bore cartridge and a motorcycle. The recovery of the weapon has been effected from his co-accused Rohit Kumar. He further submits that 03 out of the 20 prosecution witnesses have been examined so far. I have, with the assistance of the learned State counsel, examined the paper-book/the status report filed by the State. Undoubtedly, the petitioner is the main accused. The complainant stands examined and has supported the prosecution case, Harinder Singh @ Sunny, an eye-witness is yet to be examined and therefore, the petitioner cannot be granted the concession of bail. However, keeping in view the fact that the FIR is dated 11.05.2018, the Trial Court is directed to conclude the Trial within six months from the next date fixed before it.
