ARUN MONGA, J.(ORAL) Petition is for issuance of a writ in the nature of Certiorari for quashing the appointment order dated 03.07.1997 (Annexure P17) issued by the respondent No.2 whereby respondent No.3 has been given appointment as Data Entry Operator and for issuance of a writ in the nature of mandamus directing the respondents to regularise the petitioner as Data Entry Operator by changing his cadre from Lab Attandant w.e.f. 29.04.1994 and also to pay him salary and allowance attached to the past.

Learned counsel for the petitioner submits that the petition is rendered infructuous as during the pendency of the writ petition the petitioner has already been offered the post of Assistant Programmer on which he has already joined.
