Prayer in the instant application under Section 378(4) Cr.P.C., has been made for grant of special leave to file appeal against the judgment of acquittal dated 10.10.2016, passed by the learned Judicial Magistrate Ist Class, Kurukshetra, in Criminal Complaint No. 6 of 2013, dated 16.03.2012, under Sections 420, 409, 467, 468, 471 and 120-B IPC, titled as "Kulwant Singh Vs. Ashwani Kumar and others".

Briefly stated, the applicant filed a complaint under Sections 420, 409, 467, 468, 471 and 120-B IPC before the Magistrate, levelling allegations against the respondents that they have cheated him on following two counts:- (i) The respondents charged a sum of ` 10,61,000/- extra from the petitioner.
(ii) The respondents told the petitioner that the plot purchased by him through them was surrounded by streets on its three sides, but instead of streets there were Rishu Kataria 2017.08.24 16:23 I attest to the accuracy and authenticity of this document two drains on its both the sides.

Learned counsel for the applicant has not been able to point out even a single infirmity in the impugned judgment of acquittal which in the considered opinion of this Court has been beautifully written by the trial Court, dealing each and every contention of the applicant. Hence, the instant application being completely devoid of any merit is dismissed.
