The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of award dated 17.03.1998 (Annexure P-3) whereby Labour Court has ordered to pay 25% of difference of wages of the post of Shift Attendant and daily wager to the workman.

Mr.Pardeep Rajput, Advocate submits that differential amount as ordered by Labour Court comes to Rs.46,000/-. There is an order for interest as well.

Counsel for respondent No.2 submits that grievance of workman would be redressed if he is paid lump sum Rs.50,000/-. He would waive his claim of interest.

Considering the efflux of time, amount involved and paras 50-52 of judgment of Supreme Court in Central Council for Research in Ayurvedic Sciences and another v. Bikartan Das and others, 2023 SCC OnLine SC 996 and to put the litigation to rest, this Court deems it appropriate to direct the management to pay a sum of Rs.50,000/- as lump sum payment to workman towards full and final settlement. Let the needful be done within 3 months from today.

The petition stands disposed of.
