**** HARNARESH SINGH GILL , J. (ORAL) Case is being taken up for hearing through video conferencing. This is a petition under Section 439 Cr.P.C. for grant of regular bail to the petitioner in FIR No. 95 dated 3.7.2019 under Sections 302, 506/34 IPC registered at Police Station Sadar, Bathinda. Learned counsel for the petitioner submits that petitioner is a juvenile and the only allegation against him is that he caught hold of Mani Singh and pinned him down. He further submits that there is no allegation against the petitioner that the stick, which the petitioner was holding, had been used by him. Moreover, final report has been presented before the Principal Magistrate, Juvenile Justice Board and the petitioner has been in custody since 3.7.2019 Learned State counsel has pointed out that evidence is going on but he has not disputed the fact that no injury has been attributed to the petitioner.

CRM-M No. 7002 of 2020 -2The petitioner has been in custody since 3.7.2019. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
