Counsel for the applicant submits that applicant is stated to have been expired during pendency of the appeal.

Given above, application for leave to appeal is disposed of as abated. However, it is clarified that if legal heirs of the applicant want to challenge the acquittal of private respondents, filing of the present application shall not come in their way. It is further clarified that the time for which the present application was pending, shall not be counted for the purpose of limitation. Pending applications if any, stand disposed of.
