*** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of Certiorari for quashing impugned order dated 12.07.2001 (Annexure P-8) whereby petitioner's claim for promotion as Sub Divisional Officer was rejected whereas his juniors were granted promotion to the said post. Further prayer has been made for issuance of a writ in the nature of Mandamus directing the respondents to consider the claim of the petitioner for promotion/current duty charge. 2.
Petition was noticed for hearing on 03.09.2001. 3.
When taken up for final adjudication, learned counsel is unable to assist the Court for lack of instructions. Learned counsel for the petitioner states that despite repeated attempts, his office could not contact the petitioner.
In the premise, no useful purpose would be served by issuing fresh notice to the petitioner as the same too would be an exercise in futility. 4.
It seems that by sheer effluxion of time and pendency of the writ petition for more than 21 years before this Court, either it has been rendered infructuous or else the petitioner seems to have lost interest in pursuing the same. Be that as it may, writ petition is dismissed with liberty to the petitioner to file an appropriate application in case any cause of action still survives. 6.
