When confronted with the observation that the documents furnished alongwith the tender form by the authorized representative of the petitioner himself were forged and fabricated then how he could escape from the liability being principal and thus no error is there in the impugned order whereby he was black listed and earnest money was forfeited. Learned counsel for the petitioner finding it difficult to assail the proposition sought leave of the Court to permit withdrawal of the petition.

Prayer made is allowed.
