Counsel for the appellant submits that as per his instructions in an appeal preferred by the respondents against conviction under Section 323/325 read with Section 34 of the IPC, the parties have compromised and, thus, he has instructions not to press present application seeking leave to appeal against the acquittal of the respondents No.2 and 3 for offences punishable under Section 379, 452 IPC. Ordered accordingly.
