This petition has been filed under Section 482 of the Cr.P.C. for quashing the order dated 06.01.2026 passed by the learned Special Court, Hoshiarpur, whereby the learned Judge cancelled the bail bonds and surety bonds of the petitioner and issued non-bailable warrants in FIR No. 150 dated 25.11.2020 under Section 15 of the NDPS Act, registered at Police Station Mehtiana, District Hoshiarpur.

Learned counsel for the petitioner submits that the petitioner could not appear before the learned trial Court as he was out of station in connection with his occupation, being a driver transporting goods from one State to another. As such, ld. trial Court cancelled his bail and his bail bonds and surety bonds were ordered to be forfeited to the State and petitioner was ordered to be summoned through non-bailable warrants of arrest. He further prays that the petitioner is ready and willing to join the proceedings before the Court and the impugned order dated 06.01.2026 be set aside. On the asking of the Court, Mr. Rishabh Singla, AAG, Punjab accepts notice on behalf of the respondent-State. 5.

I have heard learned counsel for the parties and gone through the case file.

In view of the prayer made by the petitioner, this Court does not find any legitimate ground to interfere in the impugned order dated 06.01.2026 (Annexure P-3) passed by learned Judge, Special Court, Hoshiarpur. However, in case the petitioner surrenders before the trial Court within a period of 07 days from today at 10:00 A.M and moves an application for grant of regular bail, the trial Court is directed to consider and decide the same within a period of 03 days.
