The applicant has come up against the judgment of acquittal dated 26.07.2017 passed by the Judicial Magistrate Ist Class, Faridabad, under Section 378(4) Cr.P.C. 2.

Counsel for the applicant-appellant submits that despite his best efforts, he is unable to get correct address of the accused-respondent(s). 3.

Given above, the present Leave to Appeal is dismissed with liberty reserved to the applicant-appellant to file fresh in case the appellant-convict gets correct address of the respondent(s).

It is clarified that filing and disposal of the present leave to appeal shall not come in the applicant-appellant's way. Also, the period for which the present leave to appeal was pending before this Court shall not be counted for the purpose of limitation.
