Challenge in the present petition is to the orders dated 10.09.2025 and 12.01.2026 passed by Additional Sessions Judge, Sri Muktsar Sahib in case titled as "State of Punjab Versus Ikattar Singh @ Nanak", arising out of FIR No. 99 dated 23.05.2022 registered under Section 22 of NDPS Act, 1985 at Police Station Kotbhai, District Sri Muktsar Sahib, whereby bail granted to the petitioner was cancelled and he was summoned through non-bailable warrants.

On 06.02.2026, following order was passed by this Court:- "Learned counsel appearing on behalf of the petitioner inter alia contends that the petitioner was granted interim bail on 23.06.2022. He was regularly appearing before the Trial Court, however, on 10.09.2025, he could not appear before the Trial Court due to reasons beyond his control. Resultantly, bail of the petitioner was ordered to be cancelled, surety bonds were forfeited and non-bailable warrants were issued against the petitioner. He submits that the petitioner is ready and willing to appear before the Trial Court within a period of 10
-2days and submit himself to the proceedings as per law. Notice of motion.
Ms. Savi Nagpal, AAG, Punjab enters appearance and accepts notice on behalf of respondent-State and prays for some time to complete instructions and file reply, if so advised. Adjourned to 17.04.2026.
Reply, if any, be filed on or before the adjourned date with copy in advance to the learned counsel opposite. In the meanwhile, in the event of petitioner appearing before the Trial Court within a period of 10 days from today, subject to deposit of costs of Rs.25,000/- with the "Nishkam Sewa High Court Lawyers Society, A/C No.43373609961, IFSC Code: SBIN0050306, State Bank of India, High Court Branch, Chandigarh, he shall be admitted to interim bail by the Trial Court on his furnishing of bail/surety bonds to its satisfaction.
The impugned order dated 10.09.2025 shall remain stayed for a period of 10 days from today to enable the petitioner to appear before the Trial Court." 3.
Today, no one has appeared on behalf of the petitioner. Reply by way of affidavit of Sh. Arun Mundan, PPS, DSP, Sub Division Gidderbaha, District Sri Muktsar Sahib filed on behalf of the respondent is taken on record. Registry to tag the same at an appropriate place. Para No. 9 thereof reads thus:- "9. That the coercive steps even could not acclaim the presence of petitioner-accused and he did not appear before the Ld. Trial Court on next dates of 12-01-2026 and 18-032026. Thus fresh non bailable warrants have been ordered to be issued for 02-07-2026. The petitioner has not surrendered
-3before the Ld. Trial court within a stipulated period of 10 days and failed to comply with the order dated 06-02-2026 passed by this Hon'ble Court. From the perusal of the overall proceedings taken place in this case so far, the deliberate nonappearance of petitioner is evident. As such the petitioner deserves no concession and present petition is liable to be dismissed."

It is evident that notwithstanding the order passed by this Court granting him a period of 10 days' to appear before the trial Court, the petitioner has chosen neither to appear before the trial Court, nor to deposit the costs, as ordered and, thus, it is seems that the absence of the petitioner is willful and he only wishes to abscond from the proceedings of the trial Court so as to cause an inordinate delay in determination thereof. 5.
Consequently, keeping in view the conduct of the petitioner and his repeated non-compliance, he does not deserve the concession. 6.
Thus, the present petition is dismissed.
