(ORAL) In the present writ petition, the grievance raised by the petitioners is that the petitioners were asked to discharge the duties of the higher post of Junior Engineer, for which period, the petitioners were entitled for the salary of the post of Junior Engineer, which has not been extended to the petitioners so far.

Learned counsel appearing on behalf of the petitioners argues that the question of law as to whether an employee will be entitled for the salary of the higher post, on which post he has been asked to discharge the duties, though on temporary basis and current duty charge basis, has already been settled and the judgments to this effect, have been attached with the present writ petition.

Learned counsel appearing on behalf of the petitioners prays that a direction be issued to the respondents to grant salary to the NARESH KUMAR 2020.03.03 11:01 I attest to the accuracy and integrity of this document Chandigarh

Learned counsel for the petitioners further states that for the relief, which has been claimed in the present writ petition, petitioners have served respondents with legal notice dated 08.11.2019 (Annexure P-20), which is still pending consideration with respondents and the petitioners will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice. In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioners, the respondents are directed to decide the legal notice dated 08.11.2019 (Annexure P-20) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order.
