" 1. Reply dated 05.04.2024 in the form of an affidavit of Deputy Superintendent of Police, Sub-Division, Patti, District N.C. No.2024:PHHC:060640 CRM-M-8861-2024 (O&M) -2Tarn Taran has been filed. The same is taken on record. Copy thereof has been supplied to learned counsel for the petitioner.

2. Learned counsel for the petitioner inter alia contends that the petitioner is innocent and has been falsely implicated in this case on the alleged disclosure statement of co-accused Gursewak Singh.

3. He further contends that the petitioner has nothing to do with the said transaction nor has he ever involved in dealing in the narcotics.

4. Learned counsel for the petitioner submits that no other case is registered against the petitioner under NDPS Act and is ready to join the investigation.

5. Per contra, learned State Counsel on instructions from ASI Sewak Singh, P.S. Sarhali, District Tarn Taran has not disputed the factual matrix and has intimated that no previous case under NDPS Act is registered against the petitioner.

6. Be it as the case may be.

7. Without commenting on the merits of the case, the petitioner is hereby directed to join investigation within seven days from today and in the event of his arrest, he is ordered to be released on interim bail on his furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. He shall also abide by conditions as envisaged under Section 438(2) Cr.P.C."
