Through the instant petition under Section 438 of Code of Criminal Procedure, 1973, the petitioner seeks anticipatory bail in case FIR No.421, dated 13.10.2022, registered under Sections 406, 498-A of IPC, at Police Station Sohana, District SAS Nagar.

As per the report of Mediator, the mediation proceedings have remained unsuccessful.

Vide order dated 16.02.2023 passed by this Court, the petitioner was released on interim bail and was directed to join investigation. As per the Status report already filed by the respondent-State, recovery of dowry articles had been effected but the complainant was not coming forward to identify the same. The non recovery of some of the dowry articles is not a ground to deny, benefit of bail to the petitioner. He has already joined the investigation proceedings and his custodial interrogation is no more required Keeping in view the nature of the subject offences and the entire facts and circumstances but without commenting on the merits of the case, the present petition is allowed and the order dated 16.02.2023 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
