NIRMALJIT KAUR, J. (ORAL) The present petition is filed for issuance of a writ in the nature of mandamus to step up the pay of the petitioner at par w.e.f. 01.07.2006 equal to Mangal Sain, junior to the petitioner, in view of the instructions, dated 13.11.2018, and release all the consequential benefits accrued in favour of the petitioner.

The petitioner joined on the post of work charge mistry. Later on, he was appointed on the post of Chowkidar on 07.08.1979, on 15.10.1982 promoted on the post of LDC and further promoted as UDC and thereafter, he retired from the post of UDC on 31.03.2013. The similarly situated employees, with this very grievance, approached this Hon'ble Court by filing CWP No.10885 of 2014 titled as "Khem Chand vs Uttar Haryana Bijli Vitran Nigam Limited and others" which had already been allowed by this Court vide judgment dated 28.03.2016.

CWP-4550-2020 -2The petitioner made requests to the respondents for stepping up the pay as given to the junior Sh.Mangal Sain, UDC, in view of the notification dated 12.09.2018, Annexures P-2 and P-3, and made a detailed representation to the respondent department. The petitioner also sent a legal notice dated 26.09.2019, but the same is still pending. In view of the above, the petition is disposed of with a direction to the respondents to consider the said legal notice and take a final decision in case the petitioner is found to be covered by the judgment rendered in the case of Khem Chand (supra), Annexure P-4, as also the instructions, Annexures P2 and P3, as expeditiously as possible and preferably within three months from the date of receipt of a certified copy of this order or else they shall pass a speaking order.
