(ORAL) This is a repeat (second) bail application filed by the petitioner before this Court under Section 439 Cr.P.C. for grant of regular bail in case FIR No. 09 dated 09.01.2022 registered under Section 20(b) (ii)C of the NDPS Act at Police Station Salem Tabri, District Ludhiana. Learned counsel for the petitioner submits that the trial Court has charge-sheeted the petitioner under Section 20(c) of the NDPS Act. Therefore, keeping in view the facts and circumstances of the case, he may be released on regular bail. In support of his contention, learned counsel for the petitioner has relied upon a judgment of Hon'ble the Apex Court in Amarsingh Ramjibhai Barot vs. State of Gujarat, 2005(7) SCC 550.

CRM-M-8838-2023 -2CRM-M-40066-2022 for grant of regular bail under Section 439 Cr.P.C. which has been dismissed by this Court by passing a detailed order dated 08.12.2022.

Learned counsel for the petitioner has failed to show as to whether there is any substantial change in the circumstances after rejection of the earlier bail application of the petitioner by this Court on 08.12.2022.
