(ORAL) The instant Petition has been filed under Section 439 of the Code of Criminal Procedure seeking Regular Bail on behalf of the Petitioner in case FIR No.05, dated 11.01.2021, registered under Sections 22, 25 and 29 of the NDPS Act, 1985, at Police Station Sanaur, District Patiala. 2.

The Petitioner by now has remained in detention for 21⁄2 months since 20.01.2021.

Admittedly, no recovery was effected from his conscious possession, and his complicity has transpired only on the basis of the Disclosure Statement of a co-accused apprehended with the contraband. 4.

From his Custody Certificate, it is seen that apart from the present case, the Petitioner is also involved in case FIR No.16 dated 17.02.2020 registered under Sections 22, 25 of the NDPS Act at Police DEEPAK KUMAR 2021.04.05 17:19 I attest to the accuracy and integrity of this document

Further detention of the Petitioner at this stage considering the nature of material available against him, is not called for. As such, he is ordered to be released on bail to the satisfaction of the Ld. Trial Court/Duty Magistrate concerned.
