This is the second petition for grant of regular bail to the petitioner, in case FIR No.103 dated 05.05.2022, under Section 302 of the IPC, and, Section 25 of the Arms Act, registered at P.S. Sarabha Nagar, District Police Commissionerate, Ludhiana.

At the outset itself, the learned State counsel, on instructions imparted to him by Insp. Neeraj Chowdhary, informs this Court that, out of total 26 prosecution witnesses, 11 witnesses (including the complainant) have already been examined, while 12 witnesses have been given up by the prosecution, hence now only 03 witnesses remain to be examined.

Taking into account the stage of trial, as informed supra by DEVINDER YADAV 2025.02.15 10:21 I attest to the accuracy and authenticity of this order/judgment

CRM-M-7373-2025 the learned State counsel, the learned counsel for the petitioner seeks leave to withdraw the instant petition. However, he also prays that, considering the period of incarceration suffered by the petitioner, directions may be passed upon the trial court to conclude the recording of prosecution witnesses in a time bound manner. 4.

In view of the above, the instant petition is dismissed as withdrawn. However, considering the petitioner's incarceration and his counsel's innocuous request, this Court deems it appropriate to direct the trial Court to make all efforts to examine the remaining 03 prosecution witnesses within 03 months from today. Moreover, the S.S.P. concerned is also directed to ensure the presence of the remaining prosecution witnesses, on each and every date, as fixed by the trial Court, for their examination.

Disposed of accordingly.
