State of Punjab and others

...Respondent(s)

CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA

Present:

None for the petitioner.

Mr. Avinit Awasthi, AAG, Punjab.

G.S.SANDHAWALIA, J. (Oral) The petitioner seeks reimbursement of the payment of the medical bill which was submitted by him on account of undergoing treatment for burn injuries suffered by him alongwith interest. It is the case of the petitioner that he remained in Kakkar Hospital, Amritsar from 09.06.1999 to 19.06.1999 and he had to pay `23,539.70 as charges for medicine and treatment. He had submitted the bills on 01.09.1999 but payment had not been made. Resultantly, the writ petition was filed.

The State, in its reply, has averred that it has reimbursed an amount of `13,846/- after verification. The petitioner was entitled for the said amount only and the payment has been made and a receipt dated 26.07.2002 (Annexure R-1) was attached alongwith reply. The delay is sought to be explained on the ground that the discharge card was asked from the petitioner and thereafter, the verification had been done and the amount was paid.

No replication has been filed controverting the above said allegations.

In such circumstances, keeping in view the defence taken by the State, the present writ petition is disposed of as having been rendered infructuous.
