(ORAL) The petitioners are seeking the concession of anticipatory bail in FIR No.91 dated 15.09.2024 under Sections 115(2), 118, 351(2), 126, 191(3), 190 and 351(3) of the BNS, 2023 (Section 117(2) of the BNS added later on) registered at Police Station Kiratpur Sahib, District Rupnagar.

Vide order dated 07.02.2025, the petitioners had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel for the petitioner, inter alia, contends that although the petitioner has been named in the FIR in question, however, there is no specific attribution qua him; he was allegedly part of an unlawful assembly."

Learned State counsel, on instructions from ASI Dilbaj Singh, does not dispute the factum of the petitioners having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioners are not required for further investigation much less for their custodial interrogation. 5.
In view of the above, the petition is allowed and interim order dated 07.02.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
