CORAM:
HON'BLE MR. JUSTICE AMARINDER SINGH GREWAL ****
Present:
Petitioner No.1-Javneet appearing through V.C. Mr. Ajit Kumar Sharma, DAG, Haryana.
**** AMARINDER SINGH GREWAL, J. (Oral) 1.
The present revision petition has been filed under Article 227 of the Constitution of India, seeking issuance of a direction to the learned Civil Judge (Junior Division), Hansi, to decide the Civil Suit bearing No. CS-879/2024 dated 12.11.2024, titled as "Javneet & anr. vs. Dalbir Singh etc.", in a time-bound manner or expeditiously, in accordance with law. 2.
Brief facts of the case are that the petitioner No.1-Javneet Singh and another, instituted a suit for mandatory injunction against the respondents, Dalbir Singh and others, to the effect that land measuring 114 Kanal 11 Marlas, situated in Village Bhatla, Tehsil Hansi, District Hisar, includes a Gair Mumkin road, which is the only source of ingress and egress for the petitioners/plaintiffs to their respective houses, as they are inhabitants residing near the said road. It has been alleged that respondents No.1 to 4, in collusion and connivance with respondents No.5 to 9, have illegally and unlawfully encroached upon the said land. CR-1241-2026 Notice of the said suit was issued to the respondents, who have put in appearance before the learned trial Court, and the suit is presently pending consideration.
3.
The petitioner No.1 submits that the aforesaid suit has been pending before the learned Civil Judge (Junior Division), Hansi, for the last about two years, and no effective relief has been granted till date. Accordingly, a prayer has been made for issuance of appropriate directions to the learned trial Court for expeditious disposal of the pending suit. 4.
I have heard the petitioner No.1 and have perused the paper book.
5.
In view of the nature of the order proposed to be passed, issuance of notice to the respondents is dispensed with, as the same would only delay the proceedings and entail unnecessary expenses. 6.
Considering the submissions made by the petitioner No.1, the present revision petition is disposed of without expressing any opinion on the merits of the case. Learned Additional Civil Judge (Senior Division), Kharkhoda, is directed to decide the suit as expeditiously as possible. 7.
Pending application(s), if any, also stand disposed of. (AMARINDER SINGH GREWAL) JUDGE 18.03.2026.
