Instant appeal has been filed under Section 37 of the Arbitration and Conciliation Act, 1996 (for short "the Act"), challenging order dated 21.12.2022, passed by the Additional District Judge, Jalandhar, in the application under Section 34 (2) and (3) of the Act for setting aside Arbitral Award dated 24.08.2013, passed by the Arbitrator. 2.

At the outset, counsel for the appellant seeks and is granted permission to withdraw the appeal, with liberty to file an appropriate appeal under The Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Act, 2015. 3.
