NARESH KUMAR SANGHI, J. (Oral) Learned counsel submits that under the wrong belief that the order of discharge of the respondent-accused, passed by learned Trial Court was appealable, the applicant/complainant had withdrawn the criminal revision petition from the Court of Session vide order dated 1.11.2013 and, as such, he may be permitted to withdraw the present application for leave to appeal with liberty to file a fresh criminal revision petition before the Court of Session.

CRM-A-159-MA-2014 (O&M) In case the applicant presents criminal revision petition before Court of Session within three weeks of passing of this order and also moves an application for condonation of delay in filing criminal revision petition, the prayer for condonation of delay shall be decided in view of the fact that the earlier criminal revision petition filed before the Court of Session was withdrawn by the applicant under a wrong belief.
