The petitioner has filed this third petition under Section 439 of Cr.P.C. for grant of regular bail in case bearing FIR No. 160 dated 08.05.2020, registered under Sections 304-B/34 IPC, at Police Station Sadar, Narnaul, District Mahendergarh, the first one having been dismissed as withdrawn vide order dated 07.01.2021 and the second one dismissed on merits vide order dated 14.07.2021 passed by this Court. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case; that there is no specific allegation against the petitioner; that the marriage of the petitioner and the daughter of complainant, namely, Reena, was solemnised on 28.02.2017 and out of the said wedlock one baby boy was born on 24.09.2018; that as per the
allegations, the daughter of the complainant was being tortured by the petitioner for dowry; that moreover, the Swift car, alleged to have been given at the time of marriage, was on loan and the installments were being paid by the petitioner himself to the Bank and that the daughter of the complainant has committed suicide, as she had an impression that the petitioner was in relationship with some other lady.
He further submits that the present petition has been filed owing to the change in circumstance inasmuch as, complainant-Niranjan Lal and Mange Lal, father and the real maternal uncle of the deceased-Reena, while stepping into the witness box as PW-1 and PW-2, on 11.02.2022, turned hostile. omplainant-Niranjan Lal and Mange Lal, father and real maternal uncle of the deceased-Reena, have turned hostile. The conclusion of the trial would take a long time. Therefore, no useful purpose would be served by keeping the petitioner behind the bars.
