The petitioner under arrest as per the FIR captioned above, had come up before this Court under Section 439 CrPC seeking regular bail. 2.
Short reply by way of affidavit has been filed on behalf of the State and the same is taken on record. Counsel for the State opposed the present petition on the ground that there is zero custody of petitioner in the present case. It is also submitted that petitioner is an habitual offender and undergoing sentence for six months in one case and his custody in that case is 04 months & 26 days. In another case, his sentence has already been suspended. 3.
At this stage, petitioner's counsel wants to withdraw the present petition with liberty to file a fresh with the same power of attorney, at appropriate stage. 4.
Given above, petition is disposed of as withdrawn with liberty to file a fresh petition 01.04.2024 onwards. It is clarified that power of attorney filed in the present case shall suffice and there shall be no need to file fresh power of attorney and Registry shall not raise any objection.
