(ORAL) By way of filing the present criminal miscellaneous application under Section 378(4) Cr.P.C., the applicant seeks special leave to file appeal against the judgment of acquittal dated 16.08.2013, passed by the learned Additional Chief Judicial Magistrate, Hisar, acquitting respondents No. 1 to 6 in a private criminal complaint filed by the applicant under Sections 498-A and 406 IPC. On the last date of hearing i.e. 16.08.2023, learned counsel for the respondents had submitted that all disputes between the parties have been settled and the applicant is now residing with respondent No. 1.
Learned counsel for the applicant has not disputed the abovesaid facts noticed in the previous order dated 16.08.2023. In view of the above, learned counsel for the applicant submits that he may be permitted to withdraw the instant criminal miscellaneous application.
