(Oral) It is submitted that building plans were submitted for carrying out major renovation to an existing building in July 2019 but no response has been received till date. Thus, legal notice dated 06.03.2020 (Annexure P-5) has been issued, yet, no communication has been received from the Municipal Corporation. Although Section 263 of the Punjab Municipal Corporation Act, 1976 provides for deemed sanction, this writ petition has been filed by way of abundant caution so that the petitioner is not embroiled in any unnecessary controversy at a later date. Notice of motion.

Mr. Arun Kaundal, DAG, Punjab, accepts notice on behalf of respondent No.1 and waives service. At the asking of the Court, learned State counsel also accepts notice on behalf of respondent No.2 and waives service. Considering the nature of order being passed, no reply is necessary to be filed.

The writ petition is disposed of with a direction to respondent No.2 to consider the pending legal notice dated 06.03.2020 (Annexure P-5) in accordance with law and decide the same by passing a speaking order within a period of six weeks from the date of receipt of certified copy of this order.
