The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.0322 dated 1.12.2015 registered for the offences under Sections 420, 467, 468 and 471 IPC at Police Station Nangal Chaudhri, District Mahindergarh. Notice of motion was issued in this case.

Mr. Sharad Kumar Yadav, learned Deputy Advocate General, Haryana has appeared on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. A perusal of the record shows that one vehicle Tata 32 seater HARPAL SINGH PARMAR 2019.03.28 10:38 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-7346 of 2019 [2] bus was purchased by Tagore High School, Nangal Chaudhary. As per the complainant, Balendra Upadhaya-present petitioner told the complainant that this bus was auctioned by one Manoj Chakarvarthy, resident of Kolkata, of Tata Motors Finance and he had bought the same from Manoj Chakarvarthy vide agreement dated 29.7.2013.

As per the prosecution version, the RC and other papers have been found forged and the statement of even Manoj Chakarvarthy has been recorded.

Keeping in view the serious allegations against the present petitioner and in view of the fact that the petitioner is required for custodial interrogation, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail.

Therefore, finding no merit in this petition, the same is dismissed.
