**** HARNARESH SINGH GILL, J.(Oral) This is a petition for quashing of FIR No.01 dated 01.01.2019 registered under Sections 420 and120-B IPC, Police Station Haibowal, Police District Commissionerate Ludhiana, District Ludhiana (Annexure P-1), along with all the consequent proceedings arising therefrom, on the basis of compromise dated 12.02.2021 (Annexure P-2) arrived at between the parties.
Vide order dated 04.03.2021 passed by this Court, the trial Court/Illaqa Magistrate had been directed to record the statements of the parties with regard to the genuineness and authenticity of the compromise.
In compliance thereof, the learned Judicial Magistrate, 1st Class, Ludhiana, has submitted a report, vide letter dated 01.04.2022 which indicates that one of the accused, namely, Ranbir Kataria, had AMAN JAIN 2022.10.12 17:22 I attest to the accuracy and authenticity of this order/judgment
CRM-M-9836-2021 (O&M) -2absented himself from the Court without any intimation and accordingly, he was ordered to be summoned through non-bailable warrants of arrest. Since, one of the accused is absconding and non-bailable warrants of arrest have been issued against him, no ground is made out to quash the FIR, on the basis of the compromise, at this stage. Dismissed.
