RAMENDRA JAIN, J. (ORAL) Through instant application under Section 378(4) Cr.P.C., complainant has sought leave to file appeal against judgment dated 08.02.2016 of the trial Court, acquitting respondent No.2 in case FIR No.05 dated 16.04.2013 under Section 304-A IPC pertaining to Police Station Purana Shalla.

FIR in question was recorded on the application moved by Khela Ram father of deceased Sohan Singh. Applicant Mohan Singh being brother of the deceased cannot be termed as 'victim'. Hence, application is dismissed.
