***** ARCHANA PURI, J. (Oral) Challenge in the present revision petition is to the order dated 01.02.2023 (Annexure P-4) passed by learned Lower Court, vide which an application for seeking transfer of petition, one filed under Section 9 of the Hindu Marriage Act (Annexure P-1) and other filed under Section 13 of the Hindu Marriage Act (Annexure P-2), to the same Court, has been dismissed. On query by the Court, it was disclosed by learned counsel for both the parties that both the cases have been fixed for arguments. Considering the same, it shall be appropriate if both the cases are decided by one and the same Court, as the core issues in both the petitions should be overlapping to some extent.

2023:PHHC:086465 CR-1112-2023 In the light of the same, the revision petition is hereby accepted and both the petitions i.e. HMA-972-2017, filed under Section 9 of the Hindu Marriage Act and HMA-32-2019, filed under Section 13 of the Hindu Marriage Act, shall now be decided by the one Court on the same date, though separately. In the light of the same, HMA-972-2017 titled 'Rozy Vs. Jitesh', is ordered to be withdrawn from the Court of Additional Principal Judge, Family Court, Karnal and the same stands transferred to the Court of Principal Judge, Family Court, Karnal. Parties shall make appearance before the transferee Court on 03.08.2023.

In the meanwhile, requisite record of the transferred case be sent to the concerned Court.
